COMPARATIVE LEGAL DETERMINANTS OF PUBLIC HEALTH AND HEALTH CARE

The purpose of the study is to identify and analyse comparative legal determinants of public health and health care to improve their legal regulation in Ukraine. Materials and methods. To achieve this goal, the author used general scientific and special legal research methods, in particular: dialectical, formal and logical, comparative legal, systemic and structural, and statistical. The research materials include domestic and foreign legal acts, scientific publications and statistical data. Results. Comparative legal analysis of the determinants of public health and health care has revealed common features and differences in their legal regulation in different countries. The most important determinants include the constitutional enshrining of the right to healthcare, the existence of special legislation in the field of healthcare, the functioning of the compulsory health insurance system, public funding of the healthcare sector, training of medical personnel, development of primary healthcare, disease prevention and health promotion. For Ukraine, improving the legal regulation of the public health and healthcare sectors, taking into account international experience, is an important task on the way to building an effective and accessible healthcare system. This requires a comprehensive approach that includes modernising legislation, introducing new financing and management mechanisms, developing human resources, strengthening the preventive component and intersectoral cooperation. Taking into account comparative legal determinants will create a solid basis for reforming the healthcare sector in Ukraine in accordance with the best international standards and practices. Conclusions. A comparative legal analysis of the determinants of public health and health care opens up broad prospects for improving domestic legislation and practice, taking into account the best foreign experience and international standards. This will improve the efficiency of the healthcare system and ensure the realisation of everyone’s right to the highest attainable standard of physical and mental health.
